Ibn al-Qāṣṣ (d. 335/946), one of the representatives of the Shāfiʿī school of law in the 4th/10th century, compiled a short treatise of extraordinary nature: Fawāʾid Ḥadīth Abī ʿUmeyr. In this work, he deduces sixty different wajhs (verdicts, comments) from a ḥadīth reporting the Prophet’s interest and affection to a child known as Abū ʿUmayr and his family during a visit he paid after Abū ʿUmayr’s birdie died by jokingly telling him in rhyme, “yā Abā ʿUmayr, mā faʿala al-nughayr” (O (...) Abū ʿUmayr, what happened to the nughayr?) This study deals with the primary goal of the composition of the Fawāʾid, its content, and structural qualities as well as the author’s approach in deducing verdicts. As one of the aṣḥāb al-wujūh, the author’s legal/madhhab notion and the literalist and external perspective he developed regarding the interpretation of texts, seems to have directly affected his deductive reasoning and determined his approach. This concise work not only sheds light over certain aspects of the relationship between ḥadīth and fiqh at the time of Ibn al-Qāṣṣ, but also exemplifies to what extent methodological tendencies and personal factors might affect the process of deriving verdicts from ḥadīth and could push the limits in that regard. Nevertheless, it is surprising that many ḥadīth scholars from the early times, not only Ibn al-Qāṣṣ, have chosen this ḥadīth as an example in which they can demonstrate their skill in the field of fiqh al- ḥadīth. Fawāʾid seems to be a work in which the juridical point of view centered and resembles the classical fiqh commentaries in a sense. In the work, different variants of the Abū ʿUmayr report were brought together and evaluated within the framework of the text and textual possibilities as possible. The author also analyzed some words in the narrative text for being a base for a verdict, referred to Qurʾānic verses, prophetic ḥadīths, reports, and legal opinions, tried to solve the disputes and the conflicts among legal evidences in various ways, and stated occasionally his personal opinions. Fawāʾid reflects the author’s rich accumulation of legal knowledge, while at the same time gives an idea about his knowledge of ḥadīth and his approach to the ḥadīth. Considering what the author did and wanted to do, it is understood that he deals with ḥadīth as well as fiqh, and he has a certain level of relationship not only with fuqahāʾ (muslim jurisprudents), but also with ḥadīth scholars. Ibn al-Qāṣṣ’s interest in fiqh and ḥadīth must have lead him to take initiative to eliminate the tension between the ahl al-ḥadīth of Shāfiʿī school of law who focused on transmitting ḥadīths and the fuqahāʾ of Shāfiʿī school of law who care about the fiqh perspective, in that period of time. It can also be said that he tried to establish a reconciliation between the ahl al-ḥadīth (the traditionists) and the ahl al-raʾy (the rationalists) and bring the parties together in the middle way. The work seems to have been written as a result of such considerations. As Ibn al-Qāṣṣ was considered as one of the aṣḥāb al-wujūh, that is, as a jurist who was bound of a madhhab Imām for legal reasoning, he seems to have followed the methodology of Shāfiʿī school of law for deriving legal solutions from the sources. Legal notion of the author and his literalist and textualist perspective with regards to the interpretation of texts, seems to have directly affected his way of reasoning from the ḥadīth and determined his approach. This approach, as mentioned in many contemporary studies, is not sufficient and appropriate for the evaluation of ḥadīth texts, which were transmitted by meaning, not word-by-word, and shaped by the transmitter’s dispositions. It is also difficult to say that Ibn al-Qāṣṣ sufficiently considered the physical, historical, social, and cultural context surrounding the text as well as other extra-textual elements, which complete the meaning. This situation implies that some of the wajhs recorded in the work are the author’s attempt to find a base and evidence for his ideas, which he already had, rather than deductions drawn from the ḥadīth. It makes the scientific quality and accuracy of his efforts controversial. The verdicts presented in the work, as wajh and fāʾida are predominantly jurisprudential and compatible with the opinions of the Shāfiʿī School of law, however, there are also controversial ones, and the author pointed to them without revealing his own tendency. It does not seem that these wajhs in the work are systematically ranked. In this vein, similar wajhs are sometimes in succession, sometimes scattered, and some wajhs are repetitive. The degree of accuracy, clarity and quality of some wajhs also seem arguable. Zayn al-Dīn al-ʿIrāqī (d. 806/1404), who made a general evaluation of these wajhs, said that: “Some of the (meanings of the) wajhs in the work are apparent, some of them are hidden and some are strained.” The work’s editor drew attention in the footnotes to the wajhs, which might be subject to objection. The early ḥadīth scholars, who reported this ḥadīth in their compilations, deduced six or seven judgments from the ḥadīth under the headings (bāb) specified for this ḥadīth. This appears quite modest in comparison to the treatise of Ibn al-Qāṣṣ. The given ḥadīth has also taken its place in the fiqh literature, and it has been questioned in the context of the issue of Madīna’s being of ḥarām region (holy land) and hunting ban in this region. In conclusion, Ibn al-Qāṣṣ’s treatise of Fawāʾid Ḥadīth Abī ʿUmayr, is a short but worthy example of the ḥadīth literature in terms of its purpose and interesting content. This work can be considered as a study that exemplifies how the purpose of writing can be determinative on the structure of a work, and in particular to what extent methodological tendencies and personal factors might affect the process of deriving verdicts from ḥadīth and could push the limits in that regard. The author’s universe of meaning, which focused on the apparent meaning and to draw as many judgments as possible from the text, should be related to his personal intention and purpose as well as to the fiqh perspective of his time. Due to the textual approach and the method for drawing inferences, which are observed in the work, the tool-purpose relationship between the text and the judgment sometimes remains obscure and sometimes becomes unimportant. In some respects, this work is a striking example of the consequences of ignoring the context and historical reality surrounding texts for specific purposes. (shrink)

ABSTRACT Malaysia’s 13th general election in 2013 was the final election where the longest-serving elected government in the world, Barisan Nasional, regained power, before it was ousted after over six decades of authoritarian rule in 2018. In a country that practises parliamentary democracy but simultaneously observed close cooperation between the then ruling coalition and the mainstream press, this paper shows the micro-politics of the driving force of the coalition, United Malays National Organisation – specifically, how anxiety regarding the maintenance of (...) their privileged and empowered Malay position dominated the national narrative during the GE13 campaign. Focusing on editorial journalistic genres in four paid-for Malay-language newspapers, I illustrate the typical politics of fear that characterises much of Malaysian right-wing rhetoric – the ways in which racial and religion issues are provoked. The in-depth representational analysis, via the Discourse-historical Approach’s nomination and predication strategies, also suggests the normalisation of nationalistic and racist rhetoric, which primarily works with ‘fear’: fear of change, of loss of privilege, of the future, of other races; in principle, almost anything can be constructed as a threat to ‘Us’, an imagined homogenous people inside a well-protected territory through the discursive construction of such in-groups and out-groups. In this article, I examine the axiology of techniques in the environmentalist discourses of degrowth through the lens of French philosopher Gilbert Simondon. This fertile articulation shows, first, that degrowth discourses evaluate techniques only based on their uses; second, it explains why such an axiology, praxeological rather than technological, is unable to influence technical progress. Beginning with Simondon, I show in particular that degrowth thinking ignores the distinction between information and energy within technical realities. This paper examines the concept of _taw__ḥ__īd _ c Abd al-Ra’ūf al-Sinkīlī. Using the historical approach and content analysis, this paper argues that_ __taw__ḥ__īd__ _is an important aspect in Islam and becomes an interesting discourse in the Islamic intellectual tradition, especially _Sufism. _ c Abd al-Ra’ūf al-Sinkīlī stated that the first commitment for a human being is to accept the Oneness of Allah SWT, and purity it from all things inappropriate to Him with the statement of _lā ilaha illā Allāh_. (...) This confirmation Allah is believed as the one existence, there is no existence without the existence of Allah. In this context, there are two meanings, to negate any existence, and to confirm only one existence, which is _al-__Ḥ__aqq_. The aim of this study is to explore social media marketing activities and their impact on consumer intentions. This study also analyzes the mediating roles of social identification and satisfaction. The participants in this study were experienced users of two social media platforms Facebook and Instagram in Pakistan. A self-administered questionnaire was used to collect data from respondents. We used an online community to invite Facebook and Instagram users to complete the questionnaire in the designated online questionnaire system. Data were (...) collected from 353 respondents, and structural equation modeling was used to analyze the data. Results show that SMMAs have a significant impact on the intentions of users. Furthermore, social identification mediates the relationship between social media activities and satisfaction, and satisfaction mediates the relationship between social media activities and the intentions of users. This will help marketers how to attract customers to develop their intentions. This is the first novel study that used SMMAs to address the user intentions with the role of social identification and satisfaction in the context of Pakistan. (shrink)

L'Etat est généralement considéré, à tort comme une création des société occidentale. L'œuvre de Ibn Khaldoun, dans sa contribution innovante à la théorie de l'Etat montre au contraire combien essentiel est la nouveauté du rôle qu'il accorde au contrat social. C'est dans l'Etat que l'individu connaît son plus entier développement, le rôle du souverain n'étant pas de créer ou de promouvoir en l'homme une vie vertueuse, mais de le protéger de son propre égoïsme. Une telle mutation a eu aussitôt d'incalculables (...) répercussions dans le domaine du droit, comme celui du pouvoir. " L'Etat est à lui seul l'origine du Droit et de l'Autorité ". Cette conclusion a amené Ibn Khaldoun à envisager autrement le rapport du spirituel et du temporel. On mesure aujourd'hui l'importance de cette affirmation, qui malgré les événements qui défrayent les fragiles équilibres politiques à travers le monde, a grandement influencé le courant rationaliste arabe. L'auteur, s'appuyant sur l'œuvre d'Ibn Khaldoun, pose la question dans cet ouvrage, de l'évolution de la crise de l'Etat dans le monde arabo-musulman. (shrink)

L'oeuvre de Roshdi Rashed se deploie selon deux directions principales: la naissance, dans les Temps Modernes, des mathematiques sociales et de la theorie des probabilites d'une part, et l'histoire des sciences exactes a l'epoque de la Renaissance de l'Islam classique d'autre part. Cette oeuvre de longue haleine n'a cesse d'elargir la connaissance que nous avons de ces dernieres, par l'edition et la traduction de textes nouveaux, la reconstitution des traditions conceptuelles dans lesquelles ces textes s'inscrivent, ainsi que par la mise (...) en resonance de ces traditions. Elle agit en meme temps comme une genealogie de certaines formes de la mathesis moderne. Sans manifeste ni discours sur la methode, les travaux de Roshdi Rashed proposent un approfondissement constant de la tradition de l'epistemologie historique illustree par Gaston Bachelard et Georges Canguilhem. C'est pourquoi ces travaux ne laissent indifferent ni l'helleniste, ni bien sur l'arabisant specialiste de champs connexes, ni le medieviste, ni les specialistes de l'histoire des sciences modernes. An important, but relatively neglected, aspect of human theory of mind is emotion inference: understanding how and why a person feels a certain why is central to reasoning about their beliefs, desires and plans. The authors review recent work that has begun to unveil the structure and determinants of emotion inference, organizing them within a unified probabilistic framework.

Arguably the most prolific and most widely read philosopher of our time, Slavoj Zizek has made indelible interventions into many disciplines of the so-called human sciences that have transformed the terms of discussion in these fields. Although his work has been the subject of many volumes of searching criticism and commentary, there is no assessment to date of the value of his work for the development of these disciplines. _Zizek Now_ brings together distinguished critics to explore the utility and far-ranging (...) implications of Zizek's thought and provide an evaluation of the difference his work makes or promises to make in their chosen fields. In this article, I examine Slavoj Žižek’s Freudian-Hegelian interpretation of Mary Shelley’s Frankenstein: or the Modern Prometheus (1818), and argue that Žižek’s critique of Shelley’s ambiguous and contradictory attitude toward the French Revolution and its regime of terror remains central to the debates about the revolutionary and Enlightenment ideals today. For Žižek, Shelley employs the family myth not only to obfuscate the social reality of the French Revolution, but also to subvert the bourgeois family from within, through its transgressive sexual (...) politics. Although Shelley manages not simply to dismantle modernity, she expresses a radical commitment to a “pure Enlightenment subjectivity”. Nonetheless, Shelley fails to articulate the speculative identity of the Enlightenment and revolutionary terror. Žižek’s analysis of Shelley’s ambiguous position on emancipatory politics has major implications for his critique of Leftist debates about Muslim refugees in Europe and transgender sexuality. It is still urgent, Žižek correctly insists, to interrogate the ways in which identity politics and the human rights regime can be readily appropriated and commodified in late capitalism. (shrink)

This article revisits the controversy over the Slovenian philosopher Slavoj Žižek’s sympathetic, yet critical and provocative, views on Islam and fundamentalist terrorism as developed in his ‘A Glance on the Archives of Islam.’ Žižek, I argue, offers an original reading of the universality of Islam and its political potentiality, by reactualizing the originary impulse in Hegel’s dialectical analysis of Islam as endogenous to the series of monotheistic religions, without falling into the trap of either Hegel’s racist Orientalist, Eurocentric, and Islamophobic (...) views about Islam or their antithetical Islamocentric views. First, I show that Žižek rejects Hegel’s emphasis on both Islam’s temporal incongruity and the Islamic unique conception of an abstract and transcendent God. Instead, Žižek reloads Hegel’s dialectical views and manages to resolve the deadlock in Hegel’s approach to Islam that could not account for the universality of Islam. Second, I draw out the political aspect of Žižek’s philosophical analysis of Islam, by examining his claim that Islam is the most politicized religion today. Grounding the emergence of political Islam in the encroachment of modernization project on the Islamicate world, he notes the ambiguity about sacrifice (martyrdom and terrorism) in Islam and attributes the rise of Islamic extremism (violence) to the contradictions and impasses of the global capitalist system. A topological index of a molecular graph is a numerical quantity which helps to predict the chemical/physical properties of the molecules. The Wiener, Wiener polarity, and the terminal Wiener indices are the distance-based topological indices. In this paper, we described a linear time algorithm that computes the Wiener index for acyclic graphs and extended this algorithm for (...) unicyclic graphs. Public university business schools appear to struggle in upholding their educational self. Corporate scandals linked to business graduates raise questions about the role of PUBS in the development of civilized societies. This study develops an ethical decision making model in the PUBS context based on moral theories and then empirically tests the model. The model hypothesizes that individuals’ moral philosophies in terms of egoism and utilitarianism as well as subjective norm in terms of peer influence affect their unethical behavioural intention. (...) Moreover, this study compares ethical levels between business students with those from other disciplines. Data was collected using a structured questionnaire from established public universities in Malaysia. The data was analysed using the Smart Partial Least Squares, a second generation structural equation modelling software, as well as the SPSS version 23. The results reveal that moral philosophies and subjective norm exert positive and significant effects on unethical behaviour intention. The study, however, found no significant effect with regard to unethical behaviours between business and non-business students. The authors argue that a university’s status may explain a student’s intentions towards ethics. Implications of the results and future research are proposed. (shrink)

The Eurozone Crisis is not just a monetary and economic challenge. It is as well the first tremendous challenge of the European Community and as well the national institutions and constitutions of the member states not only within the Eurozone. On one side the European Commission, the European Parliament and the ECB with its endeavours to safeguard and stabilize the single currency EURO within the Eurozone, to support the suffering countries in the south with its struggle against speculative hedge funds, (...) to render financial relief measures to those countries and its financial industry. Irrespective the fact governments and citizens within that countries, less appear to appreciate or honor that measures as efficient help to stabilize but condemn as form of European paternalism and patronage. On the other hand the countries and its citizenship especially in the north of the Eurozone to set a stop sign to the EU and the ECB. Therefore they stress the Maastricht criteria and cite the Art 125 of the TEU, which prohibits one nation to stand for or to be liable for the Government debts of another nation. Especially in the German perspective the demarcation line appears to run along between the European Commission, European Central Bank and European Court on the European side and the Bundesverfassungsgericht, the Bundesbank on the national German side. Each of the institutions feels to be bound to its origin functions and principles and save the respective constitution and the task rendered by that constitution. For a better understanding it is essential to get aware of and to reinforce the constitutional role which the Grundgesetz awarded to the Bundesverfassungsgericht and the Bundesbank and the German citizenship placing their confidence in these institutions. The decision to procreate—to have, raise, and nurture biological children—is almost never subject to moral scrutiny. In fact, most societies implicitly embrace and advance procreation, a view known as pronatalism: procreation is morally desirable, psychologically “normal,” and generally seen as a laudable life choice. Those who cannot procreate are understood to have suffered a severe loss, and having or desiring to have children is considered an important developmental marker of increasing maturity and progression toward adulthood.However, we argue that prospective parents (...) have a defeasible moral obligation to prioritize adoption over procreation as a means of satisfying their desire to become parents.
